Energy Performance Certificates (EPC)

Energy Performance Certificates (EPC) are being introduced to help improve the energy efficiency of buildings.

From October 2008, by law if you are buying or selling a home you now need an Energy Performance Certificate. The certificate provides a rating for the building, with 'A' being the most energy efficient and 'G' being the least, with the average up to now being 'D'.

Accredited energy assessors produce EPCs alongside an associated report which suggests improvements to make a building more energy efficient.

European Energy Performance of Buildings Directive (EPBD)

Energy certificates are part of the UK governments Energy Performance of Buildings Regulations which came in to force over a range of dates beginning on April 19th 2007 and ending with full implementation on January 1 2009.

The purpose of the Regulations is to implement the European Energy Performance of Buildings Directive. (EPBD) This Directive is aimed at reducing the energy consumption and carbon emissions of buildings within the European Community. Buildings account for more than 40% of the UKs energy consumption and carbon emissions.

There are three types of energy certificates, each of which must be produced by an energy assessor qualified to produce that particular type of certificate.
  • Energy Performance Certificates (EPC)
show an asset rating based on the building fabric, insulation level, heating, lighting, cooling and control systems.
  • Display energy certificates (DECs)
use the buildings annual energy bills, useful floor area and type of activity to produce an Operational Rating (OR). The accompanying Advisory Report looks at the buildings fabric and energy systems to suggest ways of improving the rating.

NB. The Regulations also extend to the inspection of air conditioning systems as follows 4th January 2009 First inspection of all existing air-conditioning systems over 250 kW must have occurred by this date 4th January 2011 First inspection off all remaining systems over 12kW must have occurred by this date.

Penalties

Domestic EPC £200 Owner/landlord responsible – for marketed sales Estate Agent also responsible.

Non domestic EPC – 12.5% of the rateable value of the building or £750 if the formula cannot be applied. Owner/landlord responsible not agent.

DECs £500 for failing to display the certificate - £1000 for failing to have possession of an Advisory Report. The occupier of the building is responsible.
When should the EPC be made available?
1) Domestic rentals and all commercial property

A property may be marketed before an EPC is available but the EPC must be provided in the case of any of the following events
  • Written information is requested by prospective owner or tenant
  • A Viewing takes place
  • A contract is entered into
The above may take place if the EPC has been requested at least 14 days before; otherwise a penalty will be applied.

This applies to both domestic and non domestic rentals and to the sale of non domestic property.

2) Marketed domestic sales

For domestic marketed sales until April 1 2009, the property may be marketed as long as the EPC has been ordered i.e as part of the HIP. After this date the EPC must be available before even marketing can begin.

Energy Efficiency

EPC & DEC Fact List

EPC - Domestic Energy Performance Certificate

Required for all homes on construction sale or rent.

Until April 1 2009 homes may be marketed if the HIP (which includes the EPC) have been ordered and paid for or there is a promise to pay. After this date the EPC – and most other documents in the HIP – must be available before marketing can begin.

Rental EPC valid for 10 years. EPC within the HIP for marketed homes must be no more than 3 years old

Exceptions
  • House in multiple occupation where rooms are let separately
  • Care homes
  • Boarding schools
  • Holiday accommodation
EPC - Non Domestic / Commercial Energy Performance Certificate

Required for all commercial property on sale, construction or rent

Two categories
  • Level 3 existing buildings with heating systems < 100kW and cooling < 12kW
  • Level 4 New buildings and more complex existing buildings which are likely to have centralised air conditioning systems
Accompanied by Recommendation Report

Valid for 10 years

Exceptions
  • Standalone buildings <50m2
  • Places of worship
  • Temporary buildings with expected use under 2 years
  • Buildings with low energy demand e.g. agricultural barns
  • Unsafe buildings expected to be demolished
DEC - Display Energy Certificates

Required for all public buildings >1000m2

Certificate must be displayed in a prominent position e.g. in reception

Accompanied by an Advisory Report

DECs should have been in place by October 1 2008

Display certificate valid for one year

Advisory Report valid for 7 years

Exceptions

  • Buildings owned by a public authority but never visited by the public
